November 10 Trustee Election Results

There are 479 properties in Ashbrook Village, of which 106 votes (representing 22% of the properties) were submitted in the November 10 trustee replacement election and of these 5 votes were invalid due to unpaid account or incomplete ballot. Result of the votes received are as follows:

Mark Frontera 9 (8.9%)
Jason Hupka 15 (14.9%)
David Smalley 77 (76.2%)

David Smalley received the most votes, therefore elected to fill the vacant trustee position.

Ashbrook Village HOA Trustee Election

Ashbrook Village consists of 479 properties and was created by Dominion Corp as a Deed Restricted community. Deed restrictions are legally binding restrictions that are intended to protect property values by ensuring that homeowners do not change their property in ways that could lower the values of adjacent properties.

The primary purpose of deed restrictions are to maintain a certain standard throughout the development and it is the responsibility of the Homeowner's Association trustees to oversee and uphold the guidelines as defined in the recorded documents (deeds), to which all property owners are legally obligated.

The HOA's authority is limited to that which is in accordance with Code of Regulations and Special Warranty Deed. The deed restrictions are supposed to be in force for thirty (30) years and thereafter changes would require a vote of approval from 75% of all the HOA members. Prior to the thirty (30) years, it would require a vote of approval from 100% of all the HOA members.

The trustworthiness of the trustees is of vital importance to the HOA. Duties of the Homeowner's Association include collection of Association fees, maintenance of the common areas such as the entrances, fences, ponds, open areas, former gun club property, and oversight and guidance on compliance with Deed Restrictions. The HOA has contracted with a property management company to collect fees and provide guidance and expertise in screening homeowner proposals to modify their properties.

There has been talk of doing away with the management company and reverting to self-management of the HOA. In the early history of the subdivision this was attempted with less than satisfactory results and determined not to be the best choice. Just keeping track of payments and non-payment of fees takes a lot of time and energy. Self-management would also raise the potential for a conflict of interest and possible misappropriation of funds. Continuing with a management company better insures the business of the HOA is performed properly, however it is still the responsibility of the trustees to direct the management company where needed and to closely review the monthly financials.

Maintaining the integrity of our development helps to protect our property values. The standards through out Ashbrook Village are what attracts residents and sets us apart from other communities. We have little control over today’s housing market, but as property owners we do have a vote as to the trustees we elect to serve us.

As of September 14, Lachandra Baker resigned her trustee position. The Board would like all interested parties to submit nominations for consideration of this trustee vacancy, which will expire with the annual election in March 2012. Tally from the August 30 Meeting

The following are the results from the August 30 vote taken in an effort to remove board member Allen Thomas:

479 ballots were mailed out to the property owners. There were 124 names on the sign-in sheet from the meeting, representing 96 of the 479 total lots within Ashbrook Village.

112 total votes were received with 102 being affirmative, of which 45 were mailed in; 10 were negative votes, of which 1 was mailed in (however only affirmative votes are required).

75% affirmative vote (359 yes votes) from the voting power of all 479 members is required to remove a board member as per the Code of Regulations for the Ashbrook Village HOA.

21.29% affirmative votes (102 yes votes) were received from the voting power of all 479 members. The vote was short by 53.71% affirmative votes (257 yes votes), therefore the vote for board member removal failed.

Fall Community Yard Sale

Fall Yard Sales, September 9 and 10, 9 a.m. - 3 p.m.  Advertising will be a listed on Craigslist.
 
The Yard Sale Committee would like to purchase 4 double-sided signs to read "Community Yard Sale, Fri and Sat, 9 a.m. -  3 p.m." and a blank space to fill in the date every spring and fall. The signs would be plastic with black letters and used year after year. The cost is going to be $93.72 to purchase 4 double-sided, 24x36 signs for the 3 entrances and the private drive. We are collecting donations from residents to make the purchase and the signs would be used every May and September for the community yard sales.

Notice of Special Meeting on August 30 at 7 p.m., Crossroads Church

A Special Meeting of the Ashbrook Village Homeowners Association will be held on Tuesday, August 30 at 7 p.m. at Crossroads Church, 11573 Lithopolis Road, Lithopolis, OH.

A ballot was attached to the original mailing for the removal of Board Member Allen Thomas. A 75% affirmative vote is required. The ballot may be mailed to our management company, Advanced Realty Management, before the meeting or turned in at the meeting. All ballots will be kept confidential with only the final tally released to the community.
