Ashbrook Village HOA Trustee Election

Ashbrook Village consists of 479 properties and was created by Dominion Corp as a Deed Restricted community. Deed restrictions are legally binding restrictions that are intended to protect property values by ensuring that homeowners do not change their property in ways that could lower the values of adjacent properties.

The primary purpose of deed restrictions are to maintain a certain standard throughout the development and it is the responsibility of the Homeowner's Association trustees to oversee and uphold the guidelines as defined in the recorded documents (deeds), to which all property owners are legally obligated.

The HOA's authority is limited to that which is in accordance with Code of Regulations and Special Warranty Deed. The deed restrictions are supposed to be in force for thirty (30) years and thereafter changes would require a vote of approval from 75% of all the HOA members. Prior to the thirty (30) years, it would require a vote of approval from 100% of all the HOA members.

The trustworthiness of the trustees is of vital importance to the HOA. Duties of the Homeowner's Association include collection of Association fees, maintenance of the common areas such as the entrances, fences, ponds, open areas, former gun club property, and oversight and guidance on compliance with Deed Restrictions. The HOA has contracted with a property management company to collect fees and provide guidance and expertise in screening homeowner proposals to modify their properties.

There has been talk of doing away with the management company and reverting to self-management of the HOA. In the early history of the subdivision this was attempted with less than satisfactory results and determined not to be the best choice. Just keeping track of payments and non-payment of fees takes a lot of time and energy. Self-management would also raise the potential for a conflict of interest and possible misappropriation of funds. Continuing with a management company better insures the business of the HOA is performed properly, however it is still the responsibility of the trustees to direct the management company where needed and to closely review the monthly financials.

Maintaining the integrity of our development helps to protect our property values. The standards through out Ashbrook Village are what attracts residents and sets us apart from other communities. We have little control over today’s housing market, but as property owners we do have a vote as to the trustees we elect to serve us.
